Yes. In Texas, you can be charged with assault even if no one suffered a serious injury.
Many people believe that an assault charge requires broken bones, cuts, or other severe injuries. In reality, Texas law defines assault much more broadly.

Pain Alone Can Be Enough
For many assault charges in Texas, the prosecution only has to show that another person experienced bodily injury.
Under Texas law, “bodily injury” can include physical pain, even if there are no visible injuries. That means someone does not have to be seriously hurt for an assault charge to be filed.
Assault Doesn’t Always Involve Physical Injury
In some situations, an assault charge may not involve an injury at all.
Texas law recognizes other types of assault, including:
- Threatening someone in a way that places them in fear of immediate bodily harm
- Makin offensive or unwanted physical contact
Depending on the facts, these situations can still lead to criminal charges.

Text the FirmThe Facts of the Case Matter
Just because someone reports being hurt does not automatically mean you will be convicted.
A criminal defense attorney will carefully review the evidence, including:
- Police reports
- Witness statements
- Photos or videos
- Body camera footage
- Any other available evidence
Every case is different, and the evidence should be examined carefully before conclusions are made.
Don’t Assume a Minor Incident Is a Minor Case
Even an assault case involving minor injuries can have serious consequences. Depending on the circumstances, you could face fines, jail time, a permanent criminal record, and other long-term effects.
If the allegation involves a family member, roommate, or dating partner, additional consequences may apply because of the family violence designation.
