save your license after a DWI
How Do I Save My License After a DWI in Texas?

One of the biggest concerns people have after a DWI arrest is losing their driver’s license. For many Texans, driving is essential for getting to work, taking kids to school, and handling everyday responsibilities.

The good news is that a DWI arrest does not automatically mean you will lose your license. However, you have to act quickly.

There Is a Short Deadline

In Texas, you generally have 15 days from the date of your DWI arrest to request an Administrative License Revocation (ALR) hearing if your license is at risk because you refused or failed a breath or blood test.

If you miss this deadline, your license can be suspended automatically. That is why it is important to contact a Fort Worth DWI attorney as soon as possible after your arrest.

What Is an ALR Hearing?

A ALR hearing is separate from your criminal DWI case.

The purpose of the hearing is to determine whether the Texas Department of Public Safety has the legal grounds to suspend your driver’s license. Winning the hearing may allow you to keep your driving privileges.

Even if your license is ultimately suspended, the hearing can still benefit your case. It gives your attorney an early opportunity to review evidence such as dash and body camera footage, question the arresting officer under oath, and identify issues that may later help defend your DWI charge.

Can I Still Drive If My License Is Suspended?

In some situations, you may be able to obtain an Occupational Driver License. This type of license allows you to drive for essential purposes, such as:

  • Going to work
  • Attending school
  • Taking care of household responsibilities
  • Going to medical appointments

Whether you qualify depends on the facts of your case and your driving history.

Don’t Wait to Take Action

Many people make the mistake of focusing only on their criminal case and forgetting about the deadline to protect their license. Unfortunately, waiting too long can limit your options.

The sooner you speak with an attorney, the sooner they can begin protecting both your driving privileges and your defense.
